Is Surrogacy Possible in India?

Yes, but only under very strict conditions — and these rules make it inaccessible for many.

Only altruistic surrogacy involving close friends or family members is allowed in India

Even then, couples are not eligible for Indian surrogacy if they already have one or more children

As a result, most Indians requiring surrogacy now need to do so abroad

A word of caution: We strongly advise against pursuing surrogacy opportunities in certain countries. This is often due
to a lack of legal protections, ethical concerns, unreliable healthcare infrastructure, political or economic instability, challenges with immigration and citizenship, or risks of hidden costs and scams. These factors can jeopardise the
safety, well-being, and success of the surrogacy process.

What the Process Looks Like

Assessing Eligibility and Choosing a Destination

The first step is understanding which countries allow surrogacy for Indian citizens based on your marital status, sexuality, and embryo/donor availability. Intended parents must also consider legal parentage, citizenship processes, and overall costs in each location.

Selecting a Surrogacy Program or Clinic

Once a destination is chosen, the next step is identifying a reputable clinic or agency that offers surrogacy services. This includes understanding their processes, costs, timeline, and whether they provide or facilitate access to egg donors and surrogates.

Donor Selection and Embryo Creation (if needed)

If you don’t already have embryos, this is when you select an egg donor (Indian or otherwise) and undergo IVF to create embryos. Some families travel abroad for this, while others may create embryos in India and arrange for them to be shipped overseas.

Embryo or Gamete Shipping (if applicable)

When embryos or eggs have been created in India or another location, they can often be shipped to the destination clinic. This step requires attention to international shipping laws, temperature-controlled logistics, and medical documentation.

Surrogate Matching, Medical Preparation & Pregnancy Monitoring

Once embryos arrive at the destination clinic, a surrogate is matched and medically screened. After legal contracts are finalised and medical protocols are followed, the embryo transfer takes place. If pregnancy is achieved, intended parents receive regular medical updates throughout the journey — with the level of involvement varying by program and country.

Birth and Legal Processes

After the baby is born, legal processes begin — including securing birth certificates, DNA testing (if required), and applying for citizenship and passports. Indian families often need to liaise with embassies or consulates abroad and comply with Indian government requirements before returning home.

FAQS

Yes, Indian citizens can pursue surrogacy in certain countries where it is legal and regulated. However, eligibility depends on factors such as marital status, citizenship, and destination country laws. It’s important to research or get expert advice before proceeding.

Indian and South Asian egg donors can be difficult to find in many countries. Some clinics or agencies do offer access to donors of Indian descent, but availability is limited and often requires early planning or waiting periods.

Yes, it is possible to export embryos or gametes from India to some countries — but it involves complex legal, medical, and logistical requirements. Not all countries accept shipments from India, and export permits must be in place.

Costs vary significantly depending on the destination country, whether you require an egg donor, and the complexity of the legal and medical processes. In some countries, programs may start from around 30 Lakh INR, while others (like the U.S.) can cost considerably more.

In most cases, Indian citizenship can be granted if at least one parent is an Indian citizen and genetic parentage is proven. You will need to complete legal and embassy processes, including DNA testing and documentation, before returning home.
